By accessing or using EchoStream ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

EchoStream provides AI-powered audio transcription, translation, and analysis services. We offer free and paid subscription plans as described on our Pricing page.

3. Account Registration

You must create an account to use most features of the Service. You agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials.

4. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, or violates third-party rights
• Upload audio recordings of individuals without their consent
• Attempt to reverse-engineer or circumvent our systems
• Use the Service for spam, abuse, or automated scraping
• Violate any applicable laws or regulations

5. Subscription Plans & Billing

Paid plans are billed monthly. Your subscription renews automatically at the end of each billing period. You can cancel, upgrade, or downgrade your plan at any time through the billing portal. Cancellations take effect at the end of the current billing period — you retain access until then.

All prices are listed in USD. We reserve the right to change pricing with 30 days' notice.

6. Refunds

Please refer to our Refund Policy for information about refunds and cancellations.

7. Your Content

You retain ownership of all audio files and transcripts you upload or generate. By using the Service, you grant EchoStream a limited license to process your content solely for the purpose of providing the Service to you.

You represent that you have all necessary rights to the content you upload, including the right to record and share any conversations. If you use AI-assisted features such as Client Memory, you represent that you have the necessary rights and consents to process conversations through these features, including any applicable consent to build relationship profiles from those conversations.

8. Intellectual Property

The Service, including its software, design, and content (excluding your uploads), is owned by EchoStream and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, EchoStream shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Transcription accuracy may vary depending on audio quality and language.

AI-assisted features, including Client Memory and Cross-Cultural Risk Detector, provide generated analysis based on transcript content. This analysis is advisory and may be incomplete, inaccurate, or based on cultural generalizations. It is not legal, professional, or cultural advice. You are responsible for verifying any AI-generated insights before acting on them. Cross-cultural analysis reflects general tendencies and should never be used to stereotype, discriminate against, or make employment or business decisions about individuals.

12. Termination

We may terminate or suspend your account for violation of these Terms. You may close your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
